NY Trial Attorney David Schwartz Talks About The Court Backing Trump Policy on Immigrants Arrested.

YouTube transcript
0:066 seconds A federal appeals court upheld the Trump administration's policy of automatically detaining people arrested for immigration violations with no option for bond. 0:1515 seconds For more, let's welcome in our guests attorney and conservative political commentator Peter Llamas, 0:2020 seconds as well as former prosecutor and New York City trial attorney David Schwartz. Plus, our special guests are also back, doctor Tom and 0:2828 seconds Deneen Borelli. Thank you all for being with us. The policy applies to non-citizens who entered without inspection, 0:3434 seconds classifying them as applicants for admission rather than individuals already in the country, 0:3939 seconds thus denying them standard bond hearings. Peter, big win for the Trump administration's illegal immigration policy. What are your thoughts on this?
0:4646 seconds Oh, it's a huge victory for the Trump administration. I mean, 0:4949 seconds during the Obama administration actually started with 30 years ago, 0:5252 seconds certain aliens who came to the United States illegally and they had a criminal record. They were detained indefinitely. 0:5858 seconds They were not qualified for a bond. But then it became very lenient. I mean, anyone could have applied for a bond. And, 1:041 minute, 4 seconds you know, here in and they were released into the, 1:071 minute, 7 seconds into the community. But this is this is a huge victory for the Trump administration. Detaining them during they will these illegals will still 1:141 minute, 14 seconds be given some sort of due process. It doesn't mean that they will not see an immigration judge, that they will not have a hearing. They will do, but they will do this while they are being detained. 1:241 minute, 24 seconds And the definition of being detained in this case is indefinite. So that means they can be there for months or even years. And the other thing that's interesting here, 1:311 minute, 31 seconds David, is that basically there is no border. I mean, that does not matter now.
1:351 minute, 35 seconds You don't have to be nabbed at the border. It can be anywhere. And it doesn't have to be for a crime. The crime is just that you are. Yeah. And you didn't present yourself the proper way.
1:441 minute, 44 seconds So the U.S. attorney general, Pam Bondi, 1:461 minute, 46 seconds praised the Fifth Circuit Court ruling. David, will the ruling be appealed to the Supreme Court or the. 1:521 minute, 52 seconds Maybe it can even go to the full court the full fifth? I'm not sure. But what are the chances that it could be overturned? 1:581 minute, 58 seconds Yeah. Look, it should be appealed to the Supreme Court because there should be a uniform policy throughout the entire country. Remember, this is just the Fifth Circuit. 2:072 minutes, 7 seconds It's just one circuit decision. So we need a a ruling by the Supreme Court for the entire country. Look, it's 2:152 minutes, 15 seconds another tool in the toolbox for this type of detention without bond. 2:212 minutes, 21 seconds And certainly for those people that can't make a bond or a bond is not appropriate, especially those that have a criminal record. Certainly, 2:312 minutes, 31 seconds detention without a bond during the removal. The removal process is appropriate and it's the right decision. And it 2:402 minutes, 40 seconds will be appealed to the Supreme Court, though. Tom, 2:432 minutes, 43 seconds what do you think as far as the reaction here? This really shows that Trump's been right the entire time talking about this, how to 2:502 minutes, 50 seconds deal with immigration. And you know what happens now, 2:532 minutes, 53 seconds in your opinion, to the protest side, the Democratic politicians that are comparing Trump to all sorts of horrible regimes, because that's all they got. Well, they 3:013 minutes, 1 seconds could do shout, scream and protest that the Democrats are now the party of chaos and and really bringing down our constitutional 3:083 minutes, 8 seconds republic. In my humble view. But look, the most important thing here is that it is working its way through the legal process. 3:153 minutes, 15 seconds And it is going Trump's way, which means it's the American way. We don't want illegal aliens taking over our country. We don't want criminal illegal 3:243 minutes, 24 seconds aliens. It also sends a huge disincentive if they know they come in. And if they get caught, they get now detained. So this is a 3:313 minutes, 31 seconds big issue. Yeah, it's interesting, but I think it was Newt Gingrich who last week was saying,
3:363 minutes, 36 seconds we've got to figure out what how we're going to address the the illegal immigrants who haven't committed any crimes. And that may be part of this. 3:433 minutes, 43 seconds I mean, much like Reagan did, but they're still here illegally. Right. But pivoting the Department of 3:523 minutes, 52 seconds Homeland Security had been focused on getting a lot of the a lot of the illegals out of the country. That's something 4:004 minutes now that can be done. And it seems like a lot of the roadblocks that were stuck up immediately when Trump took office are now gone. 4:084 minutes, 8 seconds One of the other things that they're trying to take down a little by little is Epstein. The Epstein case, the files. 4:134 minutes, 13 seconds So the compliance with the Epstein Files Transparency Act. There are still millions of files, 4:194 minutes, 19 seconds apparently, that need to be released. What do you make of this? Look, I say release them all. Protect the victims. Those who don't want to be known. 4:284 minutes, 28 seconds There are some that have come forward because they've been protesting. But release everything. 4:324 minutes, 32 seconds The Democrats could have done this when they had the full majority. So for them to be arguing that, 4:374 minutes, 37 seconds you know, this is. Isn't that interesting? Yeah. 4:394 minutes, 39 seconds Come on, come on. They could have done this a long time ago. So that the argument is for them to to say that the 484 minutes, 48 seconds administration is stonewalling, but release everything and get this over with. Peter, what are your thoughts on this? I mean, now the Democrats are demanding the full 4:554 minutes, 55 seconds release. You've got more than, what, 3 million documents already out there. But from a legal standpoint with what was released, did the DOJ comply with the law? 5:075 minutes, 7 seconds You're asking me? Okay. So the bottom line is they are trying to comply with the law. I didn't I didn't hear my name at first. So there's 6 million 5:155 minutes, 15 seconds documents and they've released 3.5 million. It's just not something you could snap your finger and release those documents overnight. And of course, 5:245 minutes, 24 seconds there are mistakes made with the redactions. In fact, every case I've ever been involved in, there's always mistakes made with the redactions. So when 5:315 minutes, 31 seconds you're talking about 3.5 million documents, yes, 5:355 minutes, 35 seconds there will be some mistakes are obviously they can be actionable under the law. But then you have to look at what 5:435 minutes, 43 seconds the damages are for those mistakes. And those mistakes have now been remedied by the Department of Justice. And I also hate the this is a 5:525 minutes, 52 seconds criminal case. It's a criminal case. There should be no politics involved. Peter, I'll give you the last word on this. 5:595 minutes, 59 seconds I think the the fact that the Clintons will appear before the Oversight Committee, I think, is a move in the right direction. They are going to is going to be a closed 6:076 minutes, 7 seconds doors hearing is going to be sworn discovery gathering facts, and they are going to lock in the testimony. And I think it's moving the right direction. And, you know, 6:156 minutes, 15 seconds the public is going to be satisfied because everything is going to be made available through the transcript and the taped interviews that they're going to subject Clinton's at the oversight Committee. 6:256 minutes, 25 seconds Thank you, Peter, and David Schwartz, and, of course
